Terms of Service

1. Introduction

Welcome to TourGuide AI (“App”, “Service”), a mobile application operated by Jäggi & Co. Webworks KLG (“Company”, “we”, “us”, “our”), a general partnership (Kollektivgesellschaft) registered in Switzerland under UID CHE-425.063.102, Commercial Register No. CH-170.2.001.520-1.

By downloading, installing, or using the App, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

2. Description of Service

TourGuide AI is an AI-powered travel companion that generates personalized walking tours based on your preferences, including destination, duration, pace, budget, and interests. The App provides:

• AI-generated tour itineraries with points of interest
• Map-based navigation to tour stops
• PDF export and sharing of tours
• Tour saving and synchronization across devices (for registered users)

3. Eligibility

You must be at least 16 years old to use the App. By using the App, you represent that you meet this age requirement.

4. User Accounts

4.1 You may use certain features of the App as a guest without creating an account. Guest users are limited to generating single-day tours.

4.2 To access the full functionality of the App (saving tours, multi-day tours, PDF export), you must create an account using a valid email address or Apple Sign-In.

4.3 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4.4 You may delete your account at any time through the App’s settings. Upon deletion, all your data will be permanently removed from our systems.

5. Subscriptions and Payments

5.1 The App offers a “Pro” subscription at $10.00 USD per month, which provides access to premium features including unlimited tour generations, multi-day tours, and PDF export.

5.2 Subscriptions are billed through Apple’s App Store. Payment is charged to your Apple ID account at confirmation of purchase.

5.3 Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period.

5.4 You can manage and cancel your subscription in your Apple ID account settings. No refunds will be provided for the unused portion of a current billing period.

5.5 Prices may change. We will notify you of any price changes in advance. Continued use after a price change constitutes acceptance of the new price.

6. AI-Generated Content

6.1 Tour itineraries, descriptions, and recommendations are generated by artificial intelligence. While we strive for accuracy, AI-generated content may contain errors, inaccuracies, or outdated information.

6.2 We do not guarantee the accuracy, completeness, reliability, or suitability of any AI-generated content. You should independently verify important information, including but not limited to opening hours, admission prices, accessibility, and safety conditions.

6.3 AI-generated content does not constitute professional travel advice. You use this information at your own risk.

7. Third-Party Services

7.1 The App integrates with third-party services including:

• OpenStreetMap for city search functionality
• Wikipedia for city imagery
• Apple Maps for navigation
• Supabase for data storage and authentication

7.2 Your use of third-party services is subject to their respective terms of service and privacy policies.

8. Intellectual Property

8.1 The App and its original content (excluding AI-generated tour content and third-party content) are owned by Jäggi & Co. Webworks KLG and are protected by Swiss and international copyright laws.

8.2 AI-generated tour content is provided for your personal, non-commercial use. You may share generated tours via the App’s built-in sharing features.

9. Prohibited Uses

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse-engineer, decompile, or disassemble the App
• Interfere with or disrupt the App’s infrastructure
• Use automated systems or bots to access the App
• Resell or commercially redistribute AI-generated content
• Circumvent any access restrictions or usage limits

10. Limitation of Liability

10.1 To the fullest extent permitted by Swiss law, Jäggi & Co. Webworks KLG shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

10.2 We are not liable for any harm, injury, loss, or damage that may result from following AI-generated tour recommendations, including but not limited to unsafe routes, closed venues, or inaccurate information.

10.3 Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Disclaimer of Warranties

The App is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Indemnification

You agree to indemnify and hold harmless Jäggi & Co. Webworks KLG, its partners, and affiliates from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

13. Termination

13.1 We may suspend or terminate your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or us.

13.2 Upon termination, your right to use the App will immediately cease. Provisions that by their nature should survive termination shall survive.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or via email. Your continued use of the App after such changes constitutes acceptance of the new Terms.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Switzerland, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Canton of Bern, Switzerland.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
